The Nigerian Electricity Regulatory Commission (NERC) has confirmed that four state governments—Enugu, Ekiti, Ondo, and Imo—are now set to assume control of electricity generation, transmission, and distribution within their respective states. This follows the ongoing transfer of regulatory authority from NERC to state-level regulators.
In an announcement shared on the social media platform X, NERC disclosed that the regulatory transfer process is still underway for six other states: Oyo, Edo, Kogi, Lagos, Ogun, and Niger.
“As at January 10, 2025, NERC has commenced the transfer of regulatory oversight to 10 states. Once the transfers are complete, the states will be in charge of regulating their electricity markets.
“The 10 states are: Enugu, Ekiti, Ondo, Imo, Oyo, Edo, Kogi, Lagos, Ogun and Niger. The transfers have been completed for 4 states, namely Enugu, Ekiti, Ondo, and Imo, while 6 states are still in progress,” the commission stated.
This move aligns with the provisions of the Electricity Act (EA) 2023, which grants state governments and private entities the authority to engage in electricity generation, transmission, and distribution within their jurisdictions.
Under the Act, any state intending to regulate its intrastate electricity market must formally notify NERC of its plans and submit a request to transfer regulatory powers to the state authority.
NERC emphasised that state governments must adhere to all legal prerequisites, issue formal notifications, and submit a request for regulatory oversight of their intrastate electricity markets to be transferred.
Despite the decentralisation facilitated by the EA 2023, NERC will retain its role as the central regulator overseeing interstate and international electricity generation, transmission, supply, trading, and system operations.
